Bankruptcy and Business Restructuring

The firm's bankruptcy work has earned it the reputation of being one of the leading bankruptcy firms in the region.  For many years the firm has been involved in a significant way in virtually every major Chapter 11 case in the Southern District of Alabama. The active members of the firm's team include a past chair of the Alabama State Bar Bankruptcy and Commercial Law Section and the current bankruptcy section chair of the Mobile Bar Association.  

Although we often represent creditors and creditors' committees, we are particularly recognized for our effectiveness in the Chapter 11 reorganization process, (representing secured and unsecured creditors, debtors and other parties in interest), complex litigation in the bankruptcy courts, including that related to plan confirmation, avoidance of fraudulent or preferential transfers, stay relief and dischargeability issues.

We assist clients in restructuring the obligations of financially troubled entities on behalf of borrowers, lenders and equity participants.  Our firm provides sophisticated pre-bankruptcy planning representation for anticipated business insolvencies, including the negotiation and drafting of out-of-court plans of reorganization, and has represented creditors, debtors, committees, trustees, and a variety of other parties in interest in all aspects of Chapter 11.  Among the services that the firm has provided to its clients in the context of Chapter 11 proceedings are defense of avoidance actions including preferential and fraudulent transfer litigation, representation of purchasers seeking to acquire assets and businesses from debtors pursuant to Bankruptcy Code §363 or Chapter 11 plans, litigation of claims objections, assumption or rejection of leases and executory contracts, including technology licenses, resolution of disputes concerning collateral, including cash collateral, and many other types of services relating to Chapter 11 and bankruptcy generally.  The firm also provides high-level legal advice to real property owners, lessors and lenders that have interests in financially troubled real estate, anti-deficiency provisions, foreclosure and other matters.
